Notification that whereas Ellis Rudelli de
Brigerac is dead, the king, as chief lord of Brigerac and Genzak, and the other
castles and honours of the said Ellis, sent to the knights, burgesses and
others of the honour of Genzak, Geoffrey de Lezinnan, William de Valencia, the
king's brothers, Peter de Sabaudia, William de Cantilupo, Peter Chaceporc, the
treasurer, and Robert Waleraund, the steward, by whom he claimed (petirimus)
from them his due, to wit, the first keeping of the honour of Genzac. Having heard
the king's claim and arguments, they replied that they would fulfil his mandate
in the following form and under the following conditions, with this added, that
the king should cause amends to be made to them for certain injuries,
oppressions and undue exactions committed upon them by the said Ellis and his
ancestors contrary to their ancient accustomed liberties.
The form and conditions were as follows:—The
king grants, at their instance, that if the son of the said Ellis de Brigerac,
or [the brother] of the said Ellis, or any other, come to the king and demand
the inheritance of the said Ellis as his heir, the king will do them justice by
judgement of his court.
The king grants to them that the reasonable will
of the said Ellis shall be firm and stable, so that each barony late of the
said Ellis pay the debts and bequests as is ordained
in that will.
The custom which is called [omitted]
shall not be taken there any more.
All customs and oppressions or exactions,
unduly opposed by the lords of the said castle, shall by oath of five honest
and indifferent knights and burgesses, be removed.
The king grants, at their instance, that all
persons of the castle and honour of Genzak who have been against the king in
arms in this war, shall have the king's peace and come to his service if they
please; but those who will not shall henceforth be excluded from their rights
and from the commonalty of the said castle and honour.

Notification that the dean and monks of
Issigeac (de Isiaco) have surrendered to the king their town of
Issigeac, saving in all things the right of their church and of the church of
Sarlat which the king will cause to be kept by some faithful person. And the
king has caused Drew de Barentyn, his seneschal, to swear on the king's soul
that the king will not make unjust levies (non barreabimus) on that town
or the goods of the men of that town, or take them by violence, or inflict any
losses upon them, so long as they be in the king's fealty; and that evil
customs shall be abolished and good customs observed and restored (reparabuntur)
there so long as the town be in the king's hand, and the same shall be granted hereafter.
And if the king, by a peace or by his will, let it go, and afterwards
contention arise between the said dean and monks and the men of the town of the
one part and Reginald de Pontibus of the other part, touching the lordship and
customs of the town, the king will cause such contension to be settled without
delay and determined by judgment of his court and the custom of the country.

Whereas at the king's request, because of his
arduous business at Bergerac, the mayor, jurats and men of the commune of
Bordeaux came to that place with arms, and they had an old constitution whereby
they were accustomed to create a mayor and jurats amongst themselves every year,
to wit, on the fifth day after Midsummer; and in consequence of their coming to
Bergerac, it was impossible for them to be at Bordeaux to create a mayor and
jurats: the king has granted that this prorogation or change of creation shall
not hereafter be to the infraction or diminution of the mayoralty and commune
granted to them, which the king hereby confirmed as they have been accustomed

and immoveable, he, for himself and his heirs, will observe his fealty to the
king and Edward, the king's firstborn son and heir, and that he will do right
to all complaints in the court of the king or Edward, and to this he has sworn
upon the Holy Gospels. And if he do not, the following are bound as his
pledges, to wit, P[eter] de Burdegala, Aquelin Willelmi, lord of Lesparre,

these have promised for the said William, jointly and severally, that they will

Whereas Ellis Rudell of Brugariak died, the
king, as chief lord of Brugerac and Genzak and the other castles and honours
late of the said Ellis, sent to the knights, burgesses and others of the honour
of Genzak, Geoffrey de Lisen[aco] and William de Valencia, the king's brothers,
Peter de Sabaudia, William de Cantilupo, Peter Chaceporc, the treasurer, and Robert
Walerand the Steward, by whom he demanded his due, to wit, the first keeping of
the castle and honour of Genzak. The knights and burgesses answered that they
would fulfil the king's mandate under the following form and conditions, to
wit, that the king should cause to be removed all undue exactions imposed by
the lords of the castle and cause to be observed such customs as the knights
and ten burgesses of the said castle should declare upon oath to be the right
ancient customs; and that if the king should by judgement or by his will
surrender the castle with the honour to the right heirs, he should first take
security from them that definition be made in the king's court which of the
following
/
articles,
conditions, statutes or customs should be observed or abandoned. The said
knights and burgesses elected for this made a deposition to the following
effect, which William Reymundi de Genzak, sometime lord of the place, made
customary or imposed upon the borough of Genzak at the constitution or
construction of the borough, to wit:—
Whosoever of Genciak or the honour offers right
before the lord ought to be received by him.
Every scirvientum of every house of the borough
of Genciac owes 12d. a year to the lord for scirvienyium payable on the
morrow of Christmas another 12 d. on the same day for fornayium, whereby
it is lawful for any one dwelling at Genzak, within or around, to have an oven
at will on his own ground.
Everyone, who ought to come to the lord when he
sends for him, must come and find a pledge if he asks it of him.
The lord has there justice of bloodshed and
murder.
Whenever the lord goes beyond sea, the men of
the place owe him for service 500s., and the
same when he marries his daughter, and the same when he makes his son a knight.
For every pig killed and sold there
For a salmon sold there
At Whitsuntide every butcher owes the lord a
fourth part of a ram, and every shoemaker (sabatarius) 12d. for sabatagium.
At the three fairs there, to wit, at St.
Bartholomew, St. Stephen and St. Faith every year they owe the 20th and 30th (rendam
et treytam) in the customary manner from those things which they bring for sale
there.
Whenever the lord wishes to buy bread, wine or
flesh or oats, he may receive it from the sellers provided that he pays the
price within a month of the day of purchase. And the same
touching the shoeing of horses.
For every conca of corn sold there on
Thursday the lord has his hands hands full (plenus palmas) for mesurage,
whether the corn be sold by measure or by estimation.
On all corn or wine sold or bought pedage is
due, if it is drawn from the earth, unless the seller has the wine or corn from
his own vineyards or tillage (agricultura).
In the said borough the lord kept the debetum
vini, to wit, that every year for one month beginning at Easter, until
Whitsunday, unless the lord wills no one shall sell wine in the borough of
Genciac except the lord, and the lord can put a quartern (cartonem) at 1d.
more than it shall be sold at at first, but at such time nevertheless the
knights dwelling in the castle can sell their own wine to those willing to go
to the tavern except to those of the town, likewise the foraney (foranex)
that is those who are not of the castle or the borough, may sell their wine
outside at the tavern in the time debeti vini provided that those of the
borough do not buy in order to bring into the borough.
If the lord cause logs to be cut in the wood
before Christinas everyone having a beast of carriage ought to carry two loads
(saumatas) to the lord's house.
Anyone may be a tailor of cloth in the market
who will.
If anyone injuriously kill or imprison anyone
of Genzak or of the honour, he may not enter Genciac by the mandate of the lord
or another until he have first made peace with him who has suffered injury, or,
in his absence, with his friends.

If anyone of Genciac will protect (guidare)
anyone, he can do so unless it be expressly prohibited or unless he whom he
wishes to protect has taken or killed a man of the said place, and it is at the
peril of the protector if the protected in passing through a place do any
injury or damage.
If any stranger bring fish for sale at Genciac
and anyone of Genciac meet him between la Rokam and la Solega, he may not buy
fish from him except for his own eating.
If anyone of Genciac or of the honour wish to
transfer his domicile, the lord ought not to prevent him, and he ought to have
a space of 40 days wherein to transfer himself and his goods, and the lord ought
to give him and his goods security in his whole district; and the lord ought
not to take or expel anyone so long as he can establish his right (firmare jus).
From every judgement wherein the lord aggrieves
a subject (obditum) at Genciac, the aggrieved can complain or appeal at
the court of Bazas if the lord's judgement does not please him.
The lord ought to swear that he will keep the
terms which they call los dexs and their good customs, and the good men
of the place will swear afterwards to the lord that they will be good to him, straight
(plani) and loyal (Iegales) as to a good lord.
The knights and burgesses ought to have the
vendage on closes (rendagium pledurarum) and houses held of them
in the borough or the district (ambaratis).

the king has summoned him to the army and he has gone.
The king, for the confirmation of all the
aforesaid, has granted these letters to the said knights and burgesses for the
said castle and honour, sealed with his seal and that of Edward his first-born
son.

et instinctum) of the abbot of St. Ferme, if Theobald de Genzac, bailiff of
